- Client: Any natural person or legal entity (business) entering into an agreement with the Company. The Client is explicitly identified as a professional regarding the automotive industry.
- Service: The modification of software files (ECU mapping) provided by the Client to the Company via the website.
- Digital Content: Data produced and supplied in digital form (e.g., tuning files).
- Credits: Prepaid balance purchased by the Client to use the Services.

ARTICLE 3 - APPLICABILITY
- These terms apply to all offers, agreements, and deliveries of services by the Company.
- By placing an order or buying credits, the Client accepts these General Terms and Conditions.
ARTICLE 4 - THE SERVICE & DELIVERY
- The Service is strictly digital. No physical goods are shipped.
- Delivery takes place by the Company uploading the modified file to the Client’s account on the website.
- Delivery times are indicative (usually within 1 hour during business hours) but not guaranteed. Delays do not entitle the Client to damages or cancellation.
- The Client is responsible for ensuring the original file read from the vehicle is correct and that their tools (hardware) are in good working order.
ARTICLE 5 - RIGHT OF WITHDRAWAL & REFUNDS
- Digital Content Exception: In accordance with the UK Consumer Rights Act 2015, the Client acknowledges that by requesting the immediate performance of the Service (downloading the file), they waive their right to the 14-day cooling-off period (Right of Withdrawal).
- Once a file is processed or downloaded, no refunds will be issued.
- Refunds are only possible if the Company confirms that a file cannot be provided due to technical limitations on the Company's side.
ARTICLE 6 - CREDITS
- Credits purchased are non-refundable and have no expiration date as long as the account is active.
- In the event of account termination due to a violation of these terms by the Client, remaining credits are forfeited.
ARTICLE 7 - LIABILITY & DISCLAIMER (IMPORTANT)
- Motorsport Use Only: All software and services provided are intended strictly for motorsport, racing, or off-road use. The Client is responsible for checking local laws regarding the use of modified vehicles on public roads.
- No Engine Warranty: The Company provides high-quality software but cannot guarantee the mechanical condition of the Client's vehicle. The Company is not liable for any mechanical, electrical, or software damage to the vehicle (including but not limited to turbo, engine, transmission, or ECU failure) resulting from the use of the files.
- Emissions: The Client is solely responsible for compliance with emission regulations (e.g., DPF, EGR, AdBlue modifications). The Company accepts no liability for fines or legal consequences faced by the Client or end-users.
- Manufacturer Warranty: The use of tuning files may void the vehicle manufacturer's warranty. The Company is not liable for the loss of such warranty.
ARTICLE 8 - COMPLAINTS
- Complaints regarding the functionality of a file must be reported via the support ticket system within 7 days.
- The Company will attempt to revise the file to resolve the issue. If the issue persists and is proven to be a fault of the file (and not the car's hardware), the Company may, at its discretion, refund the Credits for that specific file.
ARTICLE 9 - APPLICABLE LAW & DISPUTES
- These terms are governed by the laws of England and Wales.
- Any disputes arising from this agreement shall be submitted to the exclusive jurisdiction of the courts of England and Wales.
